Terms of Service for AuraBuddy

1. Acceptance of Terms

By creating an account and/or accessing or using the Service, you represent and warrant that:

• You are at least 18 years of age and are a legal parent or guardian of the child(ren) who will use the Service.
• You have read, understood, and agree to be bound by these Terms on behalf of yourself and your child(ren).
• You consent to your child's use of the Service and the collection and use of their information as set forth in our Privacy Policy.

2. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. We will also notify you via email and/or a prominent notice on our Service prior to the change becoming effective. Your continued use of the Service after the effective date of the revised Terms means that you accept and agree to the changes.

3. Your Account and Your Child's Account

A. Parent Account:

To use the Service, a parent or legal guardian must first create an account ("Parent Account"). You are responsible for maintaining the confidentiality of your Parent Account login credentials and for all activities that occur under your Parent Account. You agree to notify us immediately of any unauthorized use of your Parent Account.

B. Child Accounts:

As part of your Parent Account, you can create one or more profiles or accounts for your child(ren) ("Child Accounts").

• You are solely responsible for managing and supervising your child's use of the Service and their Child Accounts.
• You must ensure that your child uses the Service only in a manner appropriate for their age and development and in accordance with these Terms.
• You acknowledge that we rely on your parental supervision and guidance for your child's online activities.

As detailed in our Privacy Policy, we are committed to complying with applicable children's privacy laws. We will obtain verifiable parental consent from you before collecting certain personal information from your child. By creating a Child Account and providing consent, you authorise us to collect and use your child's information as described in our Privacy Policy.

5. Access and Use of the Service

A. Licence to Use:

Subject to these Terms and your payment of any applicable fees, we grant you and your child a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes only, under your direct supervision.

B. Acceptable Use:

You agree that you and your child will not, and will not permit others to:

• Use the Service for any unlawful purpose or in any way that violates any applicable local, national, or international law or regulation.
• Engage in any activity that is harmful, abusive, harassing, defamatory, vulgar, obscene, hateful, or otherwise objectionable (as determined by us in our sole discretion).
• Upload, post, or transmit any content that infringes upon or violates the rights of any third party.
• Attempt to gain unauthorized access to the Service, other users' accounts, or computer systems or networks connected to the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use any automated system, including "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional web browser.
• Share or disclose personal information about other users (especially children) without explicit consent.
• Promote or engage in commercial activities (e.g., advertising, solicitations) within the Service.

C. Content Restrictions for Children:

The Service is designed with safety features to limit inappropriate interactions and content. You agree to ensure your child adheres to these safety features. We reserve the right to remove any content or activity we deem inappropriate or in violation of these Terms.

6. User-Generated Content

A. Your Responsibility:

You are solely responsible for any content that you or your child creates, submits, posts, displays, or links on the Service ("User Content"). You represent and warrant that you have all necessary rights to your User Content and that it does not infringe upon or violate the rights of any third party.

B. Limited Licence to Us:

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. This licence is limited to operating and improving the Service and will always respect our commitment not to sell personal information.

C. Monitoring and Moderation:

We reserve the right, but have no obligation, to monitor, review, screen, edit, or remove any User Content, at our sole discretion, particularly to ensure the safety and appropriateness for children.

7. Intellectual Property Rights

The Service and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of AURACAPITAL PTE. LTD. and its licensors. The Service is protected by copyright, trademark, and other laws of both the Singapore Republic and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AURACAPITAL PTE. LTD..

8. Fees and Payment

If you subscribe to any paid features or plans, you agree to pay all applicable fees as described on the Service. All payments are processed by third-party payment processors. You agree to their terms and conditions. All fees are non-refundable except as expressly stated otherwise or required by law. We reserve the right to change our pricing at any time, but we will provide you with reasonable advance notice before such changes take effect.

9. Termination

We may terminate or suspend your Parent Account and/or Child Accounts immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and contact us to request account deletion.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of their Service or the information, content, or materials included therein. You expressly agree that your and your child's use of the Service is at your sole risk.

11. Limitation of Liability

In no event shall AURACAPITAL PTE. LTD., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your or your child's access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your or your child's transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Indemnification

You agree to defend, indemnify, and hold harmless AURACAPITAL PTE. LTD. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your or your child's use and access of the Service, by you or any person using your account; (b) a breach of these Terms; or (c) your violation of any rights of another, including intellectual property rights.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in Singapore.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Service, and supersede and replace any prior agreements, oral or otherwise, regarding the Service.
